Judicial reorganisation agreement (law 20.720)
A Judicial Reorganization Agreement is one executed between a Debtor Company and its creditors to restructure its assets and liabilities, subject to a public legal procedure that is conducted before the corresponding Civil Trial Courts. Since the year 2014, this procedure is regulated by Law No. 20,720. To date, 235 cases have been filed and USD$3,665 billion in liabilities have been restructured, of which our Firm has led, with significant success, 75% of the total liabilities restructured in Chile.
VOLUNTARY LIQUIDATION PROCEDURES (BANKRUPTCY FILING)
It is a legal procedure that allows to formally close a company, through the assignment of its corporate assets, for the orderly payment of its debts to its creditors.
A company should submit its request for voluntary liquidation when faced with insolvency, lack of liquidity or operational unfeasibility scenarios.
The foregoing, with the purpose of minimizing labor, tax, and financial contingencies, in order for this process to affect the company in the least possible way.
